Terms of service

The agreement between you and us: what this service does, what it does not do, and what each of us is responsible for.

Who these terms are between

These terms are between you and The Local Pharmacy, which operates The Local Pharmacy. Using the service means accepting them.

You must be 18 or over and ordering for yourself, or for someone you are responsible for, to use this service.

What this service is

The Local Pharmacy connects you to licensed pharmacies near you. We are not a pharmacy and we do not dispense medicines.

The pharmacy that fills your order sells and dispenses the medicine, and does so under its own drug licence and the supervision of its registered pharmacist. We provide the platform, the delivery arrangement and the payment.

We look for one pharmacy that can fill your whole order rather than splitting it. If nothing in range has everything, you are told which item is the problem before you pay, not after.

Your account

You sign in with your mobile number and a one-time code. There is no password to remember, which also means anyone holding your phone can sign in — keep it locked.

Keep your details accurate. A delivery address that is wrong or a pin dropped on the wrong building is the commonest reason an order fails, and the delivery fee is measured from that pin.

Prescription medicines

Medicines on Schedule H and H1 are dispensed only against a valid prescription written for you by a registered medical practitioner, which a pharmacist has read and approved.

  • Upload the prescription as it was written. Do not alter it, and do not upload one issued to somebody else.
  • A pharmacist may approve some lines and refuse others, and will tell you why.
  • An approval is spent once it is dispensed. Ordering the same medicine again needs a fresh prescription.
  • Uploading a forged or altered prescription ends your account and may be reported.

Orders and prices

Placing an order is an offer to buy. It is accepted when the pharmacy accepts it, and either of us may decline before then — a medicine can sell out between your basket and the counter.

The price you see is what a licensed pharmacy near you is charging today, not the MRP printed on the pack. The MRP is a legal ceiling, and where there is a real saving against it both figures are shown.

Delivery and any platform fee are itemised with the reason for each, in full, before you pay. Prices for medicines under price control are subject to the ceilings set under the Drugs (Prices Control) Order.

Delivery

We currently deliver in parts of Kolkata, West Bengal. Coverage is turned on area by area, only once enough licensed pharmacies there can fill orders.

Delivery times are estimates and depend on the pharmacy’s opening hours, stock and the distance to your pin. The full terms are on the shipping and delivery page.

Cancellations, returns and refunds

Medicines cannot be taken back into stock once they have left the pharmacy. That is a safety rule rather than a policy we chose, and it shapes what can and cannot be returned.

What you must not do

  • Order medicines for resale, or in quantities inconsistent with personal use.
  • Upload a prescription that is forged, altered, or not issued to the person the order is for.
  • Use another person’s account, or let someone else use yours.
  • Interfere with the service, scrape it, or attempt to access data that is not yours.
  • Use the service for anything unlawful.

We may suspend or close an account that does any of these, and are obliged to report some of them.

This is not medical advice

Nothing on this site is medical advice. Product pages describe what a medicine is, not how much of it to take. Speak to a doctor or to the pharmacist filling your order about what you should take, and read the pack insert.

In an emergency, do not order online. Go to a hospital.

Our responsibility, and its limits

We are responsible for running the platform with reasonable care, for the accuracy of what we tell you about your order, and for the obligations the law places on an e-commerce marketplace.

The medicine itself is sold and dispensed by the pharmacy, and the manufacturer is responsible for the product. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019, or any liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of India. The courts at Kolkata have exclusive jurisdiction over any dispute, without prejudice to any right you have to approach a consumer forum where you live.

Changes, and how to reach us

We may change these terms. Material changes are announced in the app before they take effect, and the date at the top of this page is always the date of the current version.
